Confidentiality

All client information and materials are considered confidential and only for use by MadliArt to provide a quote or complete a project. Client information and project materials will not be given out or shared with any third party, unless otherwise requested by the client. MadliArt retains the right to use client’s name (surname is only shown with the first initial) and book title on the MadliArt website and to market and promote my services.

Exclusivity of Work

All Cover Illustrations made by MadliArt are sold with an exclusive license. This means that once the Client has made full payment of the Work, MadliArt does not have the right to sell the Work to any third party, except in rare cases where the contract is terminated (e.g. breach of contract or the Client chooses to terminate the contract), in which case the MadliArt may choose to make changes to the Work and repurpose it for use with other clients or as a pre-made cover.

Artwork rights

The copyright of the artwork maintains within MadliArt. MadliArt may use Work in their portfolio (including, but not limited to, any website that displays MadliArt works). Client has the right to use the Cover Illustration on a printed book, eBook, audiobook and also for marketing the book. The rights exclude usage of the Cover Illustration in any other way or manner including being printed on merchandise or to be resold as an artwork, unless additional license is purchased. Additional Usage

If Client wishes to make any additional uses of the Cover Illustration that are not included within Exclusive Standard License, Client agrees to seek permission from MadliArt and purchase additional license.

Authorship Credit

Client agrees that Client must include a line of attribution on the copyright page at the beginning of any book using the Work that reads: “Cover Design © MadliArt”, as well as a line of attribution on the back of the print cover that reads “Cover Design by MadliArt". Client also agrees that when asked, Client must properly identify MadliArt as the creator of Work and Client may not seek to mislead others that Work was created by anyone other than MadliArt.

Cancellation

The fee paid upfront for Work is non-refundable. Remaining percentage of the fee is negotiable depending on the status of the project. If Client nonetheless does not want or refuses to receive Work, MadliArt may decide whether or not to complete Work, and will exclusively retain all rights to Work.

Permissions & Releases

The Client agrees to indemnify and hold harmless MadliArt against any and all claims, costs and expenses, including attorney’s fees, due to materials included in the Work at the request of the Client for which no copyright permission or privacy release was requested or uses that exceed those allowed pursuant to a permission or release.

Adjustments & Modifications

Revisions are permitted within previously agreed project scope. Additional changes outside of this scope will be charged at an additional rate.

Additional Work

Any additional work or extras will be carried out under a separate agreement at an additional cost.
